Most legislations about author rights were written in order to create a balance between the creator’s monopoly and the needs of the public to access freely to the information. The exceptions and the limitations of the owner rights monopoly reflect this research of compromise between the right owners and the interest of the public. The USA and France are compelled to adjust their law to the new constraints of the digital world 110.
We will expose in a first part the traditional exceptions, before invoking the amendments to these exceptions brought by the Digital Millennium Copyright Act and the Directive on the harmonisation of certain aspects of copyright and related rights in the information society.
